1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the website meherbanindia.org and any donations, purchases, or personalization requests made through it (together, the "Platform"), operated by Meherban India Social Welfare Foundation ("Meherban India", "we", "us", "our"). By browsing the Platform, making a donation, or submitting your details through any form on the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. About Meherban India

Meherban India is a registered social welfare foundation working across India, serving underprivileged women, children, families, and animals through food, healthcare, shelter, hygiene, and education programs. Meherban India holds valid 80G and 12A registrations under the Income Tax Act, 1961, subject to renewal as required by law. Our registered address is Hawz Qazi, Delhi, India 110006.

3. Donor Eligibility & Responsibilities

You must be at least 18 years old, or donating with the involvement of a parent or guardian, and legally capable of entering into a binding contract to make a donation through the Platform. You are responsible for:

• Providing accurate, current, and complete information (name, mobile number, delivery details, and any information required to issue an 80G receipt);
• Keeping your account credentials (if any) confidential;
• Ensuring you have the right to use any payment method provided; and
• Any content you submit for personalization (see Section 7).

4. Donations

All donations made through the Platform are voluntary contributions towards the programs described on the relevant campaign or product page. By donating, you acknowledge that:

• Funds are utilised at Meherban India's discretion towards the stated cause, and towards reasonable operational and program delivery costs;
• Payments are processed through third-party, PCI-DSS compliant payment gateways (currently Razorpay). Meherban India does not store your full card, UPI, or net-banking credentials;
• All amounts are quoted and charged in Indian Rupees (₹) unless stated otherwise; and
• Delivery timelines for physical kits, distribution updates, or personalized content are estimates (shown as the "same-day cutoff" and minimum/maximum turnaround on each product) and may vary due to logistics, weather, or circumstances beyond our control.

5. Tax Exemption (80G) Receipts

Donors providing valid PAN and contact details will receive an 80G donation receipt to the email or mobile number provided, in accordance with applicable Income Tax rules. Meherban India is not responsible for the donor's individual eligibility to claim tax deduction, which depends on the donor's own tax status and the rules in force at the time of filing. Please retain your receipt for your records.

6. Cancellations & Refunds

Because donations are applied towards ongoing welfare programs, donations are generally non-refundable once processed. Exceptions are made at our discretion for:

• Duplicate or accidental charges caused by a technical or payment-gateway error;
• Incorrect amount charged due to a verified platform error; or
• Cases required by applicable law.

To request a review, email connect@meherbanindia.org within 7 days of the transaction with your payment reference. Approved refunds are credited to the original payment method within 7–10 working days.

7. Personalization, Photos & Video Wishes

Certain products allow you to add a printed message, a name on a banner, an uploaded photo, or a "wishing video" message ("Personalization Content"). By submitting Personalization Content, you confirm that it:

• Is not defamatory, obscene, hateful, or otherwise unlawful;
• Does not infringe any third party's rights; and
• May be reproduced, printed, or read aloud substantially as submitted, subject to reasonable editorial discretion for length, decency, or safety.

Photos or videos of beneficiaries shared with you as proof of impact are captured with the consent of the beneficiary or their guardian, and are provided solely for your personal, non-commercial viewing. Please do not republish beneficiary images without our written permission, to protect their privacy and dignity.

8. Prohibited Use

You agree not to:

• Use the Platform for any unlawful, fraudulent, or misleading purpose, including money-laundering or circumventing payment rules;
• Attempt to gain unauthorised access to the Platform, its data, or other users' information;
• Scrape, reverse-engineer, or interfere with the normal operation of the Platform; or
• Impersonate any person or misrepresent your affiliation with Meherban India.

9. Intellectual Property

The Meherban India name, logo, campaign photography, and website content are the property of Meherban India or its licensors and may not be copied, reproduced, or used commercially without prior written consent.

10. Third-Party Services & Links

The Platform integrates third-party services, including payment processing (Razorpay), analytics, and communication tools (email/SMS/WhatsApp), and may link to third-party websites. We are not responsible for the content, policies, or practices of any third-party service or site, and your use of them is subject to their own terms.

11. Disclaimer & Limitation of Liability

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Meherban India disclaims all warranties, express or implied, and shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, delays in delivery, or interruptions caused by third-party service providers.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Delhi, India.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our programs, legal requirements, or platform features. The "Last updated" date above reflects the latest revision. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
